Court strikes down EPA’s emissions rule
A federal court struck down the federal EPA’s emissions rule in a lawsuit partially funded by Pennsylvania Taxpayers.
My understanding of the ruling – and feel free to correct me if I’m wrong – is that the court state the federal rule wasn’t strict enough in its regulation of mercury emissions.
I don’t know of may examples of more clearly “legislating from the bench”.
